Typically most white-collar workers will make 455 per week salary and this is not one of the major factors in dispute. Most employees must meet all three tests. The employee must be compensated either on a salary or fee basis at a rate not less than 684 per week or if compensated on an hourly basis at a rate not. For example if you earn 30000 a year you would not be considered exempt but if your salary is 100000 a year you would be considered exempt from overtime as outlined in the FLSA.
